About the Role
As a Patent Agent - Medical Devices at Mercola, you'll play a crucial role in building a cutting-edge patent operation that protects innovative medical devices and health technologies. Your expertise will be instrumental in shaping the future of medical-device innovation, working closely with inventor teams and leveraging AI-powered tools to drive high-quality output. You'll operate with rare ownership, exercising your judgment and expertise to develop effective prosecution strategies.Your day-to-day responsibilities will involve reviewing, redlining, and prosecuting AI-generated patent applications, collaborating with cross-disciplinary teams, and identifying potential risks and gaps in claim scope. What You Will Do
- Review, redline, and prosecute AI-generated patent applications in the Medical Devices domain
- Draft and prosecute provisionals, non-provisionals, PCT filings, and continuations
- Respond to office actions involving §102, §103, §112(f), enablement, and claim-construction issues
- Conduct examiner interviews and develop prosecution strategies for device-related claims
- Identify claim-scope gaps, structural-support weaknesses, prior-art risks, and specification inconsistencies
- Collaborate with inventor teams across mechanical, electrical, and firmware disciplines
- Feed prosecution learnings and rejection patterns back into the Patent Engine to improve drafting quality
- Operate independently under your own USPTO Patent Agent authority without attorney supervision
- Develop and maintain a deep understanding of FDA regulatory pathways and AI-assisted patent drafting workflows
What We Are Looking For
- Active USPTO Patent Bar registration in good standing
- Minimum 4 years of patent prosecution experience post-registration
- Minimum 50 patent applications drafted, prosecuted, or substantively responded to in medical-device, consumer-electronics, or sensor-hardware domains
- Strong engineering background: BSME, BSEE, BSBME, or equivalent; MS preferred
- Demonstrated expertise with §112(f) means-plus-function claim drafting and structural-support strategies
- Ability to independently sign and prosecute filings without attorney supervision
- Comfort operating in AI-assisted patent drafting workflows
- Ability to work at high production speed while maintaining substantive quality
Nice to Have
- Prior in-house medical-device IP experience
- Experience at a top-tier patent prosecution practice focused on medical devices
- Familiarity with FDA 510(k) and PMA regulatory pathways
- Experience with hydrogen inhalation devices, biosensors, wearable devices, photobiomodulation hardware, or EMF-protection technologies
- Hands-on experience with AI-driven drafting systems
